This designation provides the brand with enhanced legal protection, even in unrelated industries, safeguarding it against unauthorised use and infringement<\/p>\n\n\n\n<p>When this happened, for Ishaan Malhotra, founder of a wildly popular Indian fusion restaurant chain, it wasn\u2019t just another headline; it was a spark.<\/p>\n\n\n\n<p>He stared at the article on his phone while sipping filter coffee at one of his outlets. The recognition of \u201cTaj\u201d wasn\u2019t just about a name; it was about legacy, legal muscle, and being untouchable in the business of brands.<\/p>\n\n\n\n<p>That is when it hit him, \u201cCould my brand be next?\u201d<\/p>\n\n\n\n<p>Ishaan&#8217;s restaurant chain, \u201cMasalaTrail\u201d, had grown from a single Mumbai outlet into a 50-location powerhouse known for reinventing Indian street food with global flair. The restaurant had grown in popularity steadily, and he continued to open restaurants in several cities in India. Customers adored it, food critics sang praises, and influencers would pop by frequently.&nbsp;<\/p>\n\n\n\n<p>But popularity was not enough. Ishaan knew that in the world of IP, goodwill needs legal guardrails. If MasalaTrail was to become a legacy brand, it needed more than buzz, it needed protection. Specifically, well-known trademark protection.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-is-a-well-known-trademark\">What is a well-known trademark?<\/h2>\n\n\n\n<p>\u201cTechnically speaking, Ishaan,\u201d I said, as I flipped open my laptop, \u201ca well-known trademark is a mark that the general public associates with specific goods or services, even if they have not directly used them.\u201d<\/p>\n\n\n\n<p>We were seated in a corner booth at MasalaTrail\u2019s flagship outlet in Mumbai. The aroma of ghee-roasted makhan buns filled the air, but Ishaan was all ears.<\/p>\n\n\n\n<p>\u201cIt is not just about having a trademark,\u201d I continued. \u201cIt is about having a trademark that means something. That resonates so strongly with people that even if someone tried to use your name in a totally different industry, like shoes or beauty products, they would immediately think, \u2018Hey, that is MasalaTrail, the restaurant!\u2019\u201d<\/p>\n\n\n\n<p>Ishaan nodded slowly, stirring his coffee. \u201cSo it is like&#8230; super trademark status?\u201d<\/p>\n\n\n\n<p>\u201cExactly,\u201d I said. \u201cThe legal term comes from section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=2#:~:text=(zg)%20well%20known%20trade%20mark,indicating%20a%20connection%20in%20the\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">2(zg)<\/mark><\/a> of the Trade Marks Act, 1999. It defines a well-known trademark as one which, in the mind of a significant section of the public, connects the goods or services to the original brand, even without them directly engaging with it.\u201d<\/p>\n\n\n\n<p>This is what a trademark is according to section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=2#:~:text=(zg)%20well%20known%20trade%20mark,indicating%20a%20connection%20in%20the\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">2(zb)<\/mark><\/a> of the Trademark Act, 1999, &#8211;<\/p>\n\n\n\n<p><em>(zb) trade mark means a mark capable of being represented graphically and which is capable of distinguishing the goods or services of one person from those of others and may include shape of goods, their packaging and combination of colours;&nbsp;<\/em><\/p>\n\n\n\n<p>And well-known trademark is under section<a href=\"https:\/\/www.indiacode.nic.in\/show-data?actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=2#:~:text=(zg)%20well%20known%20trade%20mark,indicating%20a%20connection%20in%20the\" target=\"_blank\" rel=\"noopener\"> <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">2(zg)<\/mark><\/a> where it says &#8211;<\/p>\n\n\n\n<p><em>well known trade mark, in relation to any goods or services, means a mark which has become so to the substantial segment of the public which uses such goods or receives such services that the use of such mark in relation to other goods or services would be likely to be taken as indicating a connection in the course of trade or rendering of services between those goods or services and a person using the mark in relation to the first-mentioned goods or services.<\/em><\/p>\n\n\n\n<p>\u201cLike how everyone knows TATA, even if they have never bought a car or stayed in their hotels?\u201d Ishaan asked.<\/p>\n\n\n\n<p>\u201cSpot on. You can recognise them, right?\u201d<\/p>\n\n\n\n<p>\u201cWell, yes. Merc, Lacoste, and Warner Bros.\u201d<\/p>\n\n\n\n<p>\u201cYes! And what if I ask you to think about Lego\u2019s logo? You can see it, right?. It is because these marks are known so well by people.\u201d<\/p>\n\n\n\n<p>\u201cYour brand, too, is known all over India, and people immediately recognise your brand when they see the mark. But let us take a look at what all we need to go over for yours to be applicable.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"boxes-to-be-ticked\">Boxes to be ticked&nbsp;<\/h2>\n\n\n\n<p>I had a PDF of the Trade Marks Act open on screen, and a highlighted section blinked at the top, section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=11&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">11(6)<\/mark><\/a>.<\/p>\n\n\n\n<p>\u201cThis is where it all begins.\u201d, I said.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"section-11-6-the-core-criteria\">Section 11(6) \u2013 The Core Criteria<\/h4>\n\n\n\n<p style=\"padding-right:0;padding-left:var(--wp--preset--spacing--50)\"><em>(6) The Registrar shall, while determining whether a trade mark is a well-known trade mark, take into account any fact which he considers relevant for determining a trade mark as a well-known trade mark including&#8211;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>(i) the knowledge or recognition of that trade mark in the relevant section of the public including knowledge in India obtained as a result of promotion of the trade mark;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>(ii) the duration, extent and geographical area of any use of that trade mark;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>(iii) the duration, extent and geographical area of any promotion of the trade mark, including advertising or publicity and presentation, at fairs or exhibition of the goods or services to which the trade mark applies;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>(iv) the duration and geographical area of any registration of or any application for registration of that trade mark under this Act to the extent that they reflect the use or recognition of the trade mark;<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>(v) the record of successful enforcement of the rights in that trade mark, in particular the extent to which the trade mark has been recognised as a well-known trade mark by any court or Registrar under that record.<\/em><\/p>\n\n\n\n<p>\u201cThis section lays out what the Registrar must consider when deciding if a trademark is well-known. Think of it like a checklist.\u201d<\/p>\n\n\n\n<p>I listed them one by one:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Extent of recognition among the public<\/li>\n<\/ol>\n\n\n\n<p>\u201cHow many people know your brand? Not just in your city, but across India, or even internationally. With MasalaTrail, the influencer videos and food blogs help a lot here.\u201d<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>Duration, extent and geographical area of use<\/li>\n<\/ol>\n\n\n\n<p>\u201cHow long have you been using the trademark, how widely has it been used, and in what regions. The longer and broader, the better.\u201d<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>Extent of promotion<\/li>\n<\/ol>\n\n\n\n<p>\u201cThis includes ad campaigns, press coverage, social media following, collaborations with celebrities, anything that shows you have built public awareness intentionally.\u201d<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>Registrations or applications in India or abroad<\/li>\n<\/ol>\n\n\n\n<p>\u201cIf you have already registered or applied for your trademark in India and other countries, that strengthens your case.\u201d<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li>Successful enforcement<\/li>\n<\/ol>\n\n\n\n<p>\u201cHave you ever enforced your trademark rights? Won an opposition, sent a cease-and-desist, or fought an infringer? If you have defended your brand, that is big.\u201d<\/p>\n\n\n\n<p>Ishaan raised an eyebrow. \u201cSo, we basically have to prove that MasalaTrail is not just a restaurant chain, it is a brand that lives rent-free in people\u2019s heads?\u201d<\/p>\n\n\n\n<p>\u201cExactly,\u201d I grinned. \u201cIt is not just about paperwork. It is about showing you have earned your place in the public\u2019s imagination.\u201d<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"section-11-7-international-fame-counts-too\">Section 11(7) \u2013 International fame counts too<\/h4>\n\n\n\n<p>\u201cIf MasalaTrail is known outside India,\u201d I continued, \u201clike among NRIs in Dubai or London, that counts too. Section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=11&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">11(7)<\/mark><\/a> says even foreign recognition can help determine a mark\u2019s well-known status in India.\u201d<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"section-11-8-registration-\u2260-recognition\">Section <a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=11&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noopener\">11(8)<\/a> \u2013 Registration \u2260 recognition<\/h4>\n\n\n\n<p>\u201cHere is the twist: even if your trademark is not<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\"> <\/mark><a href=\"https:\/\/lawsikho.com\/blog\/legal-framework-for-protecting-designs\/\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">registered<\/mark><\/a>, the Registrar can still declare it well-known. That is how powerful this status is. You just need to show recognition.\u201d<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"section-11-9-no-need-for-use-in-all-classes\">Section 11(9) \u2013 No need for use in all classes<\/h4>\n\n\n\n<p>\u201cAnother myth,\u201d I said, \u201cis that you must be using your mark in every class of goods or services. But<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\"> <\/mark><a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=11&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">11(9)<\/mark><\/a> makes it clear, you don\u2019t. Your mark can still be declared well-known even if it is only used in, say, Class 43 (restaurants) and not others.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/lh7-rt.googleusercontent.com\/docsz\/AD_4nXcFlAQORUeJxdglwCPEuQNMsb2moSX_WGQcHMI7aoBUiK5yitaT7A6HLY6_qzT1VUMI6fI62Qdb29cyflkFzgDYE0NM6Y9TS_ii_IksVfG838aICokt3VQgz2or9_hBg1GwRT51iQ?key=GOtWD5m44D5lIh9mpgFdHVpp\" alt=\"\"\/><\/figure>\n\n\n\n<p>Ishaan scribbled notes in his journal. \u201cOkay, so if I want MasalaTrail to be like Taj, I need to show long-term use, massive public recognition, national media presence, maybe a few enforcement actions&#8230; and possibly international buzz?\u201d<\/p>\n\n\n\n<p>\u201cExactly. And once we have gathered all that,\u201d I said, \u201cwe can go two ways: ask the Registrar to include it in the well-known list under Rule <a href=\"https:\/\/www.ipindia.gov.in\/TM-Rules-2017.htm#124\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">124<\/mark><\/a> or wait for a court to declare it during litigation.\u201d<\/p>\n\n\n\n<p>Rule <a href=\"https:\/\/www.ipindia.gov.in\/TM-Rules-2017.htm#124\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">124<\/mark> <\/a>of <a href=\"https:\/\/ipindia.gov.in\/TM-Rules-2017.htm\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">Trademark Rules, 2017<\/mark><\/a> &#8211;\u00a0<\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>Determination of Well Known Trademark by Registrar. \u2014 (1) Any person may, on an application in Form TM-M and after payment of fee as mentioned in First schedule, request the Registrar for determination of a trademark as well-known. Such request shall be accompanied by a statement of case along with all the evidence and documents relied by the applicant in support of his claim.<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>(2) The Registrar shall, while determining the trademark as well-known take in to account the provisions of sub section (6) to (9) of section <\/em><a href=\"https:\/\/www.indiacode.nic.in\/show-data?abv=null&amp;statehandle=null&amp;actid=AC_CEN_11_60_00004_199947_1517807323972&amp;orderno=11&amp;orgactid=AC_CEN_11_60_00004_199947_1517807323972\" target=\"_blank\" rel=\"noreferrer noopener\"><em><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-secondary-color\">11<\/mark><\/em><\/a><em>.<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>(3) For the purpose of determination, the Registrar may call such documents as he thinks fit.<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>(4) Before determining a trademark as well-known, the Registrar may invite objections from the general public to be filed within thirty days from the date of invitation of such objection.<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>(5) In case the trademark is determined as well-known, the same shall be published in the trademark Journal and included in the list of well-known trademarks maintained by the Registrar.<\/em><\/p>\n\n\n\n<p style=\"padding-left:var(--wp--preset--spacing--50)\"><em>(6) The Registrar may, at any time, if it is found that a trademark has been erroneously or inadvertently included or is no longer justified to be in the list of well-known trademarks, remove the same from the list after providing due opportunity of hearing to the concerned party.<\/em><\/p>\n\n\n\n<p>Ishaan leaned back in the booth, thoughtful. \u201cLet us go the Registrar route. I don\u2019t want to wait for a court case.\u201d<\/p>\n\n\n\n<p>\u201cYes, another advantage is that under section 11(10), the Registrar must protect well-known trademarks by refusing or cancelling registrations of similar marks, considering public knowledge and potential confusion.\u201d, I said.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"how-to-apply-for-a-well-known-trademark\">How to apply for a well-known trademark?&nbsp;<\/h2>\n\n\n\n<p>The next day, Ishaan was back in my office, a folder full of campaign reports and press clippings under one arm. \u201cAlright,\u201d he said, settling into the chair across my desk, \u201cI want to apply. What do we need to do?\u201d<\/p>\n\n\n\n<p>I smiled and said, \u201cGood.
