And if you plan to raise funds from abroad, sell your product globally, or partner with foreign companies, they will expect you to have sorted this out. In the US, in Europe, even in China, IP risks in AI are already under the microscope.\u201d<\/p>\n\n\n\n<p>Kumar ran a hand through his hair, sighing. \u201cSo what exactly are these IP risks? Are they only about data?\u201d<\/p>\n\n\n\n<p>\u201cNot at all,\u201d Lily said, pulling out a notebook from her bag. \u201cThere are five big ones you need to know:<\/p>\n\n\n\n<p>First, copyright risks are due to the data you use for training, and also the outputs your AI generates.<\/p>\n\n\n\n<p>Second, patent risks if your model or method is already patented by someone else.<\/p>\n\n\n\n<p>Third, trade secret risks, for example, if your AI accidentally leaks confidential information.<\/p>\n\n\n\n<p>Fourth, trademark risks, like if your AI generates someone else\u2019s brand or logo by mistake.<\/p>\n\n\n\n<p>And fifth, open source license risks because many AI tools and libraries come with strict open source license terms you must follow.\u201d<\/p>\n\n\n\n<p>Kumar\u2019s eyes widened. \u201cWait. Even the data I use to train my AI could be a risk?\u201d<\/p>\n\n\n\n<p>Lily nodded. \u201cYes. You would be surprised how messy this can get. Look at what happened to <a href=\"https:\/\/www.pinsentmasons.com\/out-law\/analysis\/getty-images-v-stability-ai-implications-copyright-law-licensing?\" target=\"_blank\" rel=\"noopener\">Stability AI in the UK<\/a>. Ross Intelligence<\/em><\/strong>, where a legal AI startup allegedly used <a href=\"https:\/\/www.loeb.com\/en\/insights\/publications\/2025\/02\/thomson-reuters-v-ross-intelligence-inc\" target=\"_blank\" rel=\"noopener\">copyrighted legal databases<\/a> to train their system without consent.\u201d<\/p>\n\n\n\n<p>\u201cYikes,\u201d Kumar said, sitting up straight. \u201cBut nothing like that has happened in India yet, right?\u201d<\/p>\n\n\n\n<p>\u201cNot yet,\u201d Lily said, flipping a page in her notebook, \u201cbut the principles are the same. Another thing to worry about.\u201d<\/p>\n\n\n\n<p>Lily smiled. \u201cDo not worry. I will walk you through it. The key is to identify these risks early before they explode. Let us start with the most common problem area: your AI\u2019s training data.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-are-ai-related-ip-risks\">Intellectual property risks with generative AI<\/h2>\n\n\n\n<p>Kumar stirred his cold coffee absentmindedly, his mind racing.<\/p>\n\n\n\n<p>\u201cLily, this is starting to sound serious. But can you explain these risks properly? I mean\u2026 what exactly do you mean by copyright risk or patent risk in an AI product? You keep mentioning these names, but I need to understand what they actually mean for my startup.\u201d<\/p>\n\n\n\n<p>Lily smiled and leaned back in her chair.<\/p>\n\n\n\n<p>\u201cFair enough. This is probably the biggest and most common trap for AI startups. Why? Because your AI system needs data to learn lots of it. That training data often includes text, images, music, and code, all of which could be protected by copyright. If you use such data without permission, you could be infringing someone\u2019s copyright, even if the data came from the internet.\u201d<\/li>\n<\/ol>\n\n\n\n<p>Kumar frowned. \u201cBut hang on, the internet is full of free data. If something is on Google, surely it is free to use, right?\u201d<\/p>\n\n\n\n<p>Lily shook her head firmly. \u201cNo, Kumar. That is the biggest myth. Just because something is on the internet does not mean it is free to use for commercial AI training. Take the <a href=\"https:\/\/www.judiciary.uk\/wp-content\/uploads\/2025\/01\/Getty-Images-and-others-v-Stability-AI-14.01.25.pdf\" target=\"_blank\" rel=\"noopener\"><strong><em>Getty Images v. Stability AI case<\/em><\/strong><\/a>, I told you about Getty&#8217;s claims that Stability AI scraped their copyrighted photos without consent to train an AI model. That is a classic example of training data copyright risk. The same thing can happen in India under the <a href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/1367\/5\/a1957-14.pdf\" target=\"_blank\" rel=\"noopener\">Copyright Act, 1957<\/a>, using protected content for commercial purposes without permission is infringement here too.\u201d<\/p>\n\n\n\n<p>Kumar scribbled a note. \u201cAlright. Copyright risks, I get it. What is next?\u201d<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>\u201c<strong>Patent risks<\/strong>,\u201d Lily said, flipping the page. \u201cDid you know that many AI algorithms are patented, especially in the US and Europe? If you build your AI system using a patented method or process without a licence, you could be infringing a patent even if you did not copy it knowingly.\u201d<\/li>\n<\/ol>\n\n\n\n<p>Kumar\u2019s mouth fell open slightly. \u201cYou mean someone could have patented the AI algorithm itself?\u201d<\/p>\n\n\n\n<p>\u201cExactly,\u201d Lily said. \u201cFor example, Google and IBM hold hundreds of AI-related patents covering neural network designs, data processing techniques, and even specific machine learning methods. In India, the <a href=\"https:\/\/ipindia.gov.in\/writereaddata\/portal\/ipoact\/1_31_1_patent-act-1970-11march2015.pdf\" target=\"_blank\" rel=\"noopener\">Patents Act, 1970<\/a>, does not allow pure algorithms to be patented, but the US and Europe do. So if your product sells abroad or uses international cloud platforms, you might still be exposed to their patent rights.\u201d<\/p>\n\n\n\n<p>Kumar shook his head. \u201cGreat. So what else?\u201d<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>\u201c<strong>Trade secret risks<\/strong>,\u201d Lily continued. \u201cThis one is tricky. Suppose your AI model accidentally learns or reproduces confidential data from another source, say, a partner\u2019s database or scraped private material. You could be sued for misappropriating trade secrets.\u201d<\/li>\n<\/ol>\n\n\n\n<p>He blinked. \u201cBut AI models do not \u2018know\u2019 they are leaking trade secrets, right?\u201d<\/p>\n\n\n\n<p>Lily chuckled softly. \u201cOf course they do not, but the law does not care. What else?\u201d<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>\u201c<strong>Trademark risks<\/strong>,\u201d Lily said, ticking off her list. \u201cImagine your AI text generator produces fake ads mentioning \u2018Nike\u2019 or \u2018Apple\u2019 or creates a fake logo that resembles Starbucks. That is trademark infringement, your startup could get sued even if it was the AI that generated it.\u201d<\/li>\n<\/ol>\n\n\n\n<p>\u201cThat actually happens?\u201d Kumar asked, wide-eyed.<\/p>\n\n\n\n<p>\u201cAll the time abroad,\u201d Lily said. \u201cThere have been cases of AI generating celebrity faces or known brands without permission. In India, under the Trade Marks Act, 1999, this could count as infringement if it confuses consumers or dilutes the brand value.\u201d<\/p>\n\n\n\n<p>Kumar groaned. \u201cThere is more, is there not?\u201d<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li>Lily laughed. \u201cOne last one, <strong>open source licence risks<\/strong>. Many AI models and tools like PyTorch, TensorFlow, and even parts of OpenAI\u2019s software are open source. But open source comes with license terms. Some, like MIT or Apache licences, are permissive. Others, like GPL or AGPL, can force you to disclose your own source code if you use their software improperly in your product. A lot of startups ignore this and get into legal trouble later.\u201d<\/li>\n<\/ol>\n\n\n\n<p>Kumar scribbled frantically. \u201cAlright. So five major risks are copyright, patents, trade secrets, trademarks, and open source. All these could hit an AI product?\u201d<\/p>\n\n\n\n<p>Lily nodded. \u201cExactly. And if you do not catch them early, they can blow up at the worst possible time during funding, acquisition, or international expansion.\u201d<\/p>\n\n\n\n<p>Kumar sighed. \u201cLily\u2026 you are ruining my weekend plans. Where is your training data coming from, Kumar?\u201d<\/p>\n\n\n\n<p>Kumar thought for a moment. \u201cA mix of open datasets, some scraped web data, some bought from third-party providers&#8230; and a bit of publicly available health data from research papers.\u201d<\/p>\n\n\n\n<p>Lily raised an eyebrow. \u201cDid you check the copyright status of all those datasets? Are they under licences like Creative Commons, MIT, or open government data terms?\u201d<\/p>\n\n\n\n<p>Kumar blinked. \u201cHonestly? No idea.\u201d<\/p>\n\n\n\n<p>Lily smiled gently. \u201cMost startups forget this. You could face trademark or publicity rights infringement.\u201d<\/p>\n\n\n\n<p>Kumar scratched his head. \u201cBut I am not telling the model to do that\u2026\u201d<\/p>\n\n\n\n<p>\u201cIt does not matter,\u201d Lily said. \u201cYou are responsible for the output. In the US, there are discussions about whether AI-generated outputs infringe copyright or personality rights. India may follow the same route, especially with the rising use of celebrity images, song voices, and product names in AI outputs.\u201d<\/p>\n\n\n\n<p>Kumar scribbled again: <em>\u2018Set output filters for brands, celebrities, logos, medical advice.\u2019<\/em><\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/lawsikho.com\/blog\/filing-a-patent-infringement-suit-in-india\/\">Patent infringement<\/a> risks<\/strong><\/li>\n<\/ol>\n\n\n\n<p>\u201cPatents are the silent trap,\u201d Lily said. \u201cYour AI\u2019s method, like the way it processes medical data or predicts health outcomes, could be covered by someone else\u2019s patent, especially in the US or EU.\u201d<\/p>\n\n\n\n<p>\u201cBut algorithms are not patentable in India,\u201d Kumar said.<\/p>\n\n\n\n<p>Lily nodded. \u201cTrue, under the <a href=\"https:\/\/ipindia.gov.in\/writereaddata\/portal\/ipoact\/1_31_1_patent-act-1970-11march2015.pdf\" target=\"_blank\" rel=\"noopener\">Indian Patents Act, 1970<\/a>, pure algorithms and mathematical methods are not patentable. But abroad, they can be. And if you launch in the US or Europe or even use their cloud platforms, you could infringe their patents without realising it.\u201d<\/p>\n\n\n\n<p>Kumar\u2019s face fell. \u201cHow do I check this?\u201d<\/p>\n\n\n\n<p>\u201cYou need a freedom-to-operate (FTO) analysis done by a patent expert to make sure your model\u2019s methods do not step on someone else\u2019s patented invention.\u201d<\/p>\n\n\n\n<p>He scribbled furiously: <em>\u2018FTO check before global launch.\u2019<\/em><\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>Open source compliance risks<\/strong><\/li>\n<\/ol>\n\n\n\n<p>\u201cLastly, open source AI tools,\u201d Lily said. \u201cMany startups build using free libraries and models. But if you mix licences wrongly like combining GPL with MIT, you could create a \u2018licence conflict\u2019 that forces you to open source your own proprietary code.\u201d<\/p>\n\n\n\n<p>Kumar groaned. \u201cAnother legal headache.\u201d<\/p>\n\n\n\n<p>She laughed. \u201cDo not worry, this one is easy if you run a regular open-source audit of your AI stack. List every library, model, or dataset you use and its license. There are even tools to automate this now.\u201d<\/p>\n\n\n\n<p>He made a note: <em>\u2018Regular OSS licence audit.
