The judicial system recognised the severity of the issue in 2021 when Justice Subramonium Prasad of Delhi High Court expressed his concern over the noticeable increase in false rape allegations.
However, fraudulent claims are not confined to rape. According to the National Crime Record Bureau's Crime in India 2020 report:
- 5,520 cases under Section 498A were found to be false.
- In cases of kidnapping and abduction, the police deemed 9,247 cases as fictitious.
- The police also found about 12 percent of cases under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act to be false
Once again in 2021, a Delhi court imposed a penalty of INR 2 lakh on a man who filed a false and frivolous property dispute case against his brother.
As a lawyer, one of the most important steps when dealing with false allegations is to understand the different strategies and tactics that will help you effectively navigate the legal system. This includes:
