Details of the Job/Internship
Electrotherm (India) Limited is hiring for the position of an Advocate with 5-15 years of experience to join their office in Ahmedabad.
Role and Responsibilities
Litigation & Dispute Resolution:
- Represent the company in various legal proceedings including civil, criminal, corporate, financial, and labor court cases.
- Draft, review, and file petitions, appeals, and written statements in courts and tribunals.
- Handle arbitration, conciliation, and mediation proceedings for dispute resolution.
- Collaborate with external legal counsels and law firms for complex litigation matters.
Corporate & Commercial Law:
- Ensure legal compliance in all corporate and commercial transactions.
- Draft and review business contracts, agreements, MoUs, NDAs, vendor agreements, and joint venture contracts.
- Handle company law matters, regulatory approvals, and compliance with Companies Act, SEBI, FEMA, and other statutory regulations.
- Provide legal opinions on mergers, acquisitions, and corporate restructuring.
Financial & Banking Laws:
- Advise on banking, finance, and insolvency-related legal matters.
- Handle loan agreements, debt recovery cases, and represent the company in DRT, NCLT, and other financial tribunals.
- Assist in compliance with RBI and financial regulatory requirements.
- Work on asset protection, legal risk assessment, and financial dispute resolution.
Labor & Employment Law:
- Ensure compliance with labor laws, employment laws, and industrial relations regulations.
- Handle employee disputes, grievance redressal, and representation in labor courts and tribunals.
- Advise HR and management on employee policies, POSH (Prevention of Sexual Harassment), and disciplinary actions.
- Draft and review employment contracts, non-compete agreements, and termination policies.
Criminal Law & Regulatory Compliance:
- Handle criminal law matters involving fraud, misrepresentation, breach of contract, and industrial safety violations.
- Represent the company in cases involving environmental law, health and safety regulations, and statutory compliance.
- Ensure adherence to regulatory policies and government directives concerning the manufacturing industry.
- Investigate and manage cases related to white-collar crimes, fraud, and corporate governance breaches.
Eligibility
- LLB/LLM from a reputed university.
- PQE: 5-15 years.
- Strong knowledge of civil, criminal, corporate, financial, and labor laws.
- Expertise in drafting and reviewing legal documents.
- Excellent litigation, negotiation, and advocacy skills.
- Strong analytical and problem-solving abilities.
- Proficient in legal research and case law analysis.
- Good understanding of compliance and regulatory frameworks in the manufacturing sector.
- Ability to manage multiple legal matters and work under tight deadlines.
- Strong interpersonal and communication skills to liaise with internal teams, external counsels, and government authorities.
