Details of the Job/Internship
The Legal Head will oversee all legal and compliance aspects of the IVF Center, ensuring adherence to applicable laws, regulations, and ethical guidelines. This role requires expertise in healthcare regulations, contracts, and risk management, with a focus on reproductive healthcare and patient confidentiality.
Role and Responsibilities
1. Legal Compliance:
- Ensure compliance with all applicable laws and regulations, including reproductive healthcare and assisted reproductive technology (ART) laws.
- Monitor changes in legislation affecting IVF practices and implement necessary updates to policies and procedures.
- Work closely with regulatory bodies to secure and maintain necessary licenses and approvals.
2. Contract Management:
- Draft, review, and negotiate contracts with patients, vendors, staff, and other stakeholders.
- Ensure contracts adhere to legal standards, protect organizational interests, and align with ethical guidelines.
- Manage agreements related to donor programs, surrogacy, and international collaborations.
3. Risk Management:
- Identify and mitigate legal risks associated with IVF operations, including malpractice claims and data breaches.
- Develop and implement strategies to address potential disputes and conflicts.
- Establish and oversee protocols for handling patient grievances and disputes.
4. Ethics and Confidentiality:
- Uphold patient confidentiality and ensure compliance with data protection regulations.
- Provide guidance on ethical issues related to IVF treatments, surrogacy, and embryo storage.
5. Advisory Role:
- Serve as the primary legal advisor to the board of directors, management, and medical staff.
- Provide legal opinions on new services, partnerships, and investments.
- Train staff on legal and ethical compliance, including patient consent processes and documentation.
6. Litigation Management:
- Represent the organization in legal proceedings or coordinate with external legal counsel.
- Handle disputes related to patient agreements, employee matters, or vendor contracts.
7. Policy Development:
- Draft and maintain internal policies to support compliance and mitigate risks.
- Ensure alignment with international best practices in reproductive healthcare.
Eligibility
- Bachelor’s degree in Law (LLB); Master’s degree in Law (LLM) preferred.
- Minimum 8-10 years of experience in legal advisory roles, preferably in healthcare or IVF-related industries.
- Expertise in healthcare laws, contracts, and compliance.
- Experience in managing medico-legal cases is a plus.
- Strong knowledge of ART and reproductive healthcare regulations.
- Exceptional drafting and negotiation skills.
- Ability to handle sensitive issues with discretion and professionalism.
- Strong analytical, communication, and leadership skills.
