Details of the Job/Internship
Lalji Advocates is looking for a highly skilled IPR Prosecution Advocate to join their legal team, Noida office. The successful candidate will have extensive experience in intellectual property law, focusing on the prosecution of patents, trademarks, and copyrights.
This role requires a detail-oriented professional who can manage the preparation and filing of IP applications, handle communications with relevant IP offices, and provide strategic advice to clients on IP matters.
Role and Responsibilities
IP Application Management:
- Prepare, draft, and file patent, trademark, and copyright applications.
- Manage the entire prosecution process, including responding to office actions and communicating with patent and trademark offices.
- Conduct thorough patentability, trademark clearance, and copyrightability searches and analyses.
Client Consultation:
- Provide expert legal advice to clients on IP prosecution matters.
- Develop and implement strategies for securing intellectual property protection.
- Maintain regular communication with clients to update them on the status of their applications and provide strategic advice.
Legal Research and Documentation:
- Conduct detailed legal research to support IP prosecution efforts.
- Draft and review various legal documents, including legal opinions, responses to office actions, and licensing agreements.
- Ensure all documentation is compliant with relevant laws and regulations.
Eligibility
Education: BBA LL.B
Responsibilities
- Case Management: Oversee the entire lifecycle of IP cases, including strategy, pleadings, discovery, trials, and appeals.
- Legal Research: Conduct thorough research on relevant IP laws, case laws, and industry practices.
- Drafting and Filing: Prepare and file pleadings, briefs, motions, and other legal documents for court proceedings.
- Evidence Gathering: Work on collecting, preserving, and presenting evidence that supports the client’s IP rights or defences.
- Client Communication: Advise clients on IP strategy, risk assessment, and provide updates on case developments.
- Court Representation: Represent clients in court hearings, negotiations, arbitration, and mediation.
- Expert Coordination: Coordinate with technical experts, forensic analysts, and other specialists to strengthen the client’s case.
Key Skills
- Analytical Skills: Ability to interpret complex legal and technical details related to IP.
- Communication: Strong oral and written communication skills for drafting, negotiating, and arguing cases.
- Attention to Detail: Precision is essential in IP litigation to avoid costly mistakes and ensure client protection.
- Technical Understanding: For certain IP cases, especially patents, a technical background can be advantageous.
- Negotiation Skills: Often, IP disputes can be settled out of court, so strong negotiation skills are crucial.
- Knowledge of IP Law: In-depth knowledge of national and international IP laws, including changes and trends in the industry.
Experience: 6 months to 1 year of experience in intellectual property prosecution.
Salary/Stipend
