Details of the Job/Internship
Raikar Properties is hiring for the position of Junior Lawyer with 0-5 years of experience to join their North Goa office.
Role and Responsibilities
Due Diligence:
- Conduct legal due diligence on property transactions and verify title documents.
- Provide written legal opinions on property titles, including comprehensive title verification and detailed title reports.
- Ensure all property documentation is accurate, complete, and compliant with legal and regulatory requirements.
- Manage the process of obtaining necessary approvals and permits from relevant government authorities.
- Check and evaluate zoning encumbrances and restrictions (e.g., forest/conservation area).
Legal Drafting and Documentation:
- Assist in preparing, reviewing, and drafting contracts, agreements, notices, deeds, and leases related to property transactions, ensuring all terms comply with legal requirements.
- Draft various legal documents such as suits, petitions, plaints, written statements, written arguments, replies and other matters related to civil and criminal cases, with respect to property disputes.
- Demonstrate expertise in drafting and conveyancing with a strong understanding of contracts under various legal frameworks.
- Draft and handle various types of contracts, including sale deeds, leases, mortgages, leave and licenses, partnership deeds, articles of association, shareholders' agreements, arbitration agreements, settlement agreements, hypothecation agreements, and outsourcing agreements.
- Draft meeting notices, prepare agendas, and write minutes, demonstrating knowledge of secretarial practices.
- Preparing case synopses and summaries for presentation to senior lawyers.
- Maintain organized records of all legal documents and transactions, ensuring accessibility and compliance.
Dispute Resolution & Litigation:
- Support and participate in alternative dispute resolution processes like negotiations and mediations.
- Represent the firm in legal proceedings, including court appearances.
- Manage commercial litigation matters, including drafting pleadings, handling court appearances, and conducting legal arguments.
- Possess a deep understanding of the Indian judicial system, procedural workings for civil, criminal, and other court proceedings, and the laws prevailing in different courts.
Risk Management:
- Evaluate and analyze risks related to properties, real estate projects, transactions, and investments. Maintain a systematic risk management framework and track legal risks.
- Implement a document management system for better compliance and record-keeping.
Legal Research:
- Perform in-depth legal research while drafting suits, petitions, or other related legal matters, referencing case laws and judgments to support legal arguments.
Eligibility
- 5-year Bachelor's degree in Law (BA LLB/ LLB) / Master's degree in Law (LLM) from a recognized university in India.
- Advanced certification or specialization in real estate law is an advantage.
- 0-5 years proven work experience as a Real Estate Lawyer/Legal Advisor, or a similar position in the legal industry preferably with experience in real estate.
- Demonstrated expertise in managing legal aspects of real estate transactions, including land subdivisions and plot sales, and other related legal processes.
- Valid license to practice law in India.
