Mana Projects Pvt Ltd is hiring for the position of Legal Assistant to join their office in Bengaluru.
Role and Responsibilities
Land Acquisition & Property Due Diligence
- Manage matters related to land acquisition under the Karnataka Industrial Areas Development Act (KIADB) as well as private acquisitions.
- Conduct title scrutiny and prepare Title Scrutiny Reports for property/land documents.
- Carry out due diligence for property documents and real estate transactions.
- Coordinate with government authorities and panel advocates for acquisition-related processes.
Documentation & Drafting
- Draft and review a wide range of real estate agreements, including:
- Lease Deeds, Sub-Lease Deeds, Service Agreements, Letter of Intent (LOI), Service Term Sheets (Co-Working), Leave and License Agreements, Agreement to Sell, Deed of Absolute Sale, Joint Development Agreement, Memorandum of Understanding, Release Deed, Will, Partition Deed, Surrender Deed, Gift Deed, Special Power of Attorney, General Power of Attorney, Mortgage Deed, Confirmation/Consenting Deeds, Declaratory Affidavits, etc.
- Prepare and file legal pleadings, notices, replies, petitions, appeals, and other legal documents for matters such as:
- Land Acquisition, Property Disputes, Recovery Suits, Mortgage, Lease, Damages, Declaration & Injunction suits, Consumer Cases, Arbitration, Revenue Cases, Partition Suits, Writ Petitions, Writ Appeals, Criminal Matters, and Special Leave Petitions (SLP).
- Draft agreements in compliance with RERA and proofread all documents before execution.
Litigation & Legal Advisory
- Draft pleadings, notices, and legal opinions on litigation matters.
- Handle litigation related to injunctions, declarations, recoveries, defamation, writ petitions, and related proceedings.
- Advise on valid transfer of property rights, including calculation of stamp duty and completion of registration processes.
- Represent and assist the company in revenue matters before the Tahsildar, Assistant Commissioner, and Deputy Commissioner.
Government Liaison & Regulatory Compliance
- Prepare letters and applications to authorities such as BDA, KIADB, BBMP, Panchayath, BIAAPA, HPA, Fire Department, and UDD.
- Coordinate with government offices to procure title documents and necessary approvals.
- Maintain compliance with all relevant property and real estate laws, ensuring timely registration of JDAs, GPAs, Sale Deeds, Mortgage Deeds, and other property documents at Sub-Registrar offices.
Property Records & Title Verification
- Scrutinize revenue records including RTCs, Mutation Register Extract/IHC, Index of Land, Record of Rights, Karnataka Revision Settlement Akarband, Tippaninakal, Khata Certificate, Tax Paid Receipts, and Encumbrance Certificates.
- Verify marketability of property title and provide legal opinions.
Meetings, Reporting & Research
- Attend project-related meetings with management, design, approvals teams, and landowners.
- Maintain MIS reports and regularly update the Head of Department on legal matters.
- Stay updated on amendments to relevant Acts and regulations, and advise stakeholders accordingly.
- Address and resolve legal queries raised by clients’ advocates or bank panel advocates on commercial and residential projects.
