Details of the Job/Internship
National Health Systems Resource Centre (NHSRC), New Delhi, on behalf of the Ministry of Health & Family Welfare, is seeking applications from qualified candidates for the abovementioned post purely on a contractual basis.
Role and Responsibilities
- The Legal consultant will help and assist the CMHA in preparing the Para-wise reply and also brief the Govt. Advocate and may appear along with them the court to protect the interest of the Department. matters related to Central Mental Health Authority.
- To examine and analyse law/ statute related cases and render advice.
- To prepare documents for filing in various forums connected with legal matters.
- To render advice and inputs connected with legal vetting of documents.
- To carry out any other and all tasks as may be assigned by the Central Mental Health Authority.
- To work in coordination with other officers and consultants of Central Mental Health Authority.
- To pro-actively monitor all legal issues and judicial cases in the Court cases of CMHA and assist in brief the Ld. ASG, Senior Counsels about the cases and coordinate with the Counsels in different Court cases in different States.
- Coordinate with Government Counsels and other Authorities / State Mental Health Authority / Mental Health Review Board.
- Assist Central Mental Health Authority Secretariat by regularly monitoring the progress of court cases pending.
- Coordinate with ASG/ Legal representatives to Union of India.
- Draft the para-wise/ point to point reply to the petitions and various applications of the court cases pending in Supreme Court and High Court.
- Coordinate and correspond with all concerned parties, such as within the
- Ministry of Health and Family Welfare as well as outside the Ministry of Health and Family Welfare, such as State Mental Health Authority / Mental Health Review Board.
- Drafting counter affidavits, affidavits and replies on behalf of the Central Mental Health Authority.
- Dealing with RTI matters related to CMHA.
- Attending the hearing of important court matters and briefing the matters to the Central Government Counsels and learned ASG.
Eligibility
A bachelor’s degree in law from a recognized Institution/ University.
5 years’ experience in legal matters out of which atleast 2 years of experience must be with Central Government and having exposure to the following areas:
- Handling of Court cases/ arbitration cases including those related to public interest litigations/public health emergencies/ establishment/ contractual cases at High Court and Supreme Court level.
- Experience of examination and analysis of Law/ Statute.
- Knowledge of Government administrative regulations/ experience in Legal procedures/ labour laws/ arbitration matters.
- Fluency in written and oral English/ legal drafting skills.
- Familiarity with Mental Health Programme and Government Schemes.
- Qualification & Experience of computer skills and proficiency in working on Office software.
Salary/Stipend
Rs. 88,000/- p.m. (Fixed annual increase of 5 percent per year).
