Details of the Job/Internship
They are looking for a highly skilled and proactive Legal Counsel with significant experience in industrial operations to join their team. The ideal candidate will have expertise in EPC (Engineering, Procurement, and Construction) projects, O&M (Operation and Maintenance), logistics, renewable energy, and labor laws, and will be adept at managing legal complexities across diverse industrial domains.
The Legal Counsel will oversee contract management, dispute resolution, litigation, debt recovery, and compliance to safeguard the company’s interests and ensure smooth operations across departments.
Role and Responsibilities
Debt Recovery and Claims Resolution
- Collaborate with Finance, EPC, and Logistics departments to identify and monitor outstanding debts and claims.
- Initiate timely legal proceedings or settlements, prioritizing high-value claims.
- Prepare and maintain a monthly recovery report detailing resolved claims, pending amounts, and legal actions taken.
- Ensure the recovery of overdue payments by working closely with the HEAD-FINANCE to finalize and implement recovery strategies.
Dispute and Litigation Management
- Identify and resolve disputes involving clients, vendors, and contractors through negotiation, mediation, or legal proceedings.
- Prioritize internal and external dispute resolution, ensuring settlement.
- Manage litigation cases efficiently, ensuring their closure within defined timelines.
- Establish and maintain a Litigation Management System to track cases, filing deadlines, and court hearing dates.
- Submit detailed monthly litigation status reports to management, including resolution strategies and anticipated outcomes.
Contract Management and Legal Protection
- Review and update all contract templates for EPC, Logistics, and other departments to reflect the latest legal standards and industrial best practices.
- Develop and maintain a centralised Contract Management System to monitor contract drafting, negotiation, execution, compliance, and renewals.
- Ensure 100% legal review of contracts within 7 business days of finalization.
- Conduct quarterly performance reviews of contracts with department heads to assess compliance and address emerging issues.
- Reduce contract-related disputes through enhanced clarity and protection measures during contract drafting and negotiation phases.
Legal Compliance and Risk Management
- Conduct quarterly legal audits across departments to ensure full compliance with labor laws, environmental regulations, and corporate governance standards.
- Develop and implement legal risk mitigation strategies for EPC and Logistics, addressing project delays, client escalations, and payment defaults.
- Monitor and respond to new government regulations, ensuring compliance within 30 days of notification.
- Prepare quarterly legal compliance reports, covering all regulatory areas, including corporate governance, taxation, and labor laws.
Team Leadership and Training
- Conduct quarterly legal training sessions for department heads on contract management, compliance, and dispute resolution.
- Foster collaboration by holding monthly cross-functional meetings with EPC, Logistics, Finance, and Commercial teams to address legal concerns and provide guidance.
- Prepare quarterly reports on team performance, training initiatives, and outcomes.
- Department-Specific Legal Support
EPC Department:
- Review contracts with vendors and subcontractors for ongoing projects to ensure compliance and minimize disputes.
- Monitor project delays and client escalations for potential legal issues and advise on resolutions.
Logistics Department:
- Review transportation and service contracts to ensure legal compliance and protection of company interests.
- Resolve disputes with vendors related to transportation delays and service failures.
Finance Department:
- Collaborate with the Finance team to ensure the legal recovery of overdue payments and address disputes arising from claims or defaults.
- Finalise and oversee the legal strategies for debt recovery and financial claims resolution.
Eligibility
- Bachelor’s or Master’s degree in Law (LLB/LLM), with a focus on corporate, industrial, or energy law.
- 4+ years of experience in legal advisory roles, preferably in EPC, O&M, logistics, renewable energy, or related sectors.
- Proven expertise in industrial contracts, labor law compliance, and dispute resolution.
- Comprehensive knowledge of environmental laws, corporate governance, taxation, and industrial safety regulations.
- Strong experience in litigation management, arbitration, and debt recovery strategies.
- Exceptional analytical, negotiation, and communication skills, with the ability to work in a fast-paced industrial environment.
- Preferable: Practised under a Supreme Court Advocate on Record(AOR).
- STRONGLY PREFERRED: Experience in both Litigation and Contracts Management.
Salary/Stipend
