One of the most well-known ARCs in India, it received a proper license from the RBI in 2007.

Details of the Job/Internship

Alchemist Asset Reconstruction Company Limited is hiring a Legal Manager with experience of 5 to 8 years to join their office in Delhi.

Role and Responsibilities

Law and Compliance:

• Make sure that the Recovery of Debts and Bankruptcy Act (RDBA), the Insolvency and Bankruptcy Code (IBC), the SARFAESI Act, RBI directives, and other financial regulations are followed.
• Create, examine, and negotiate contracts, such as loan sale agreements, restructuring agreements, settlements, and security enforcement agreements.
• Perform due diligence on non-performing assets (NPAs), making sure that loan paperwork, mortgage deeds, security interests, and enforcement methods are all legally vetted.
• Manage compliance reporting to the RBI and other authorities, regulatory filings, and statutory duties.

Dispute resolution and litigation:

• Represent the business in High Courts, the National Company Law Tribunal (NCLT), Debt Recovery Tribunals (DRT), and other legal proceedings.
• Oversee litigation tactics for debt restructuring, insolvency, and asset recovery.
• Organize case management and legal proceedings in coordination with outside attorneys, law firms, and advocates.
• Offer legal advice on contractual duties, recovery risks, and dispute settlement.

Enforcement & Asset Recovery:

• Create and implement legal plans for resolving stressed assets through insolvency, enforcement, and settlements.
• Manage the holding and enforcement of SARFAESI-secured assets, including settlement talks and auction procedures.
• To ensure that recovery plans are carried out smoothly, communicate with banks, NBFCs, investors, and regulatory bodies.

Risk and Corporate Management:

• Provide senior management with advice on compliance requirements, regulatory changes, and legal concerns.
• Assure appropriate risk assessment, contract management, and policy compliance inside the company.
• Support the legal framework-compliant structuring of joint ventures, distressed asset acquisitions, and M&A transactions.

Eligibility

• LLB (required), LLM (recommended), with a focus on insolvency, corporate, or banking law.
• Five to eight years of experience managing asset recovery, litigation, and financial legal compliance in an ARC, bank, NBFC, or law firm.
• Excellent knowledge of the Companies Act, RBI regulations, IBC, DRT processes, SARFAESI, and securitization legislation.
• Proficiency in contract formulation, enforcement proceedings, due diligence, and litigation management.
• Outstanding communication, analytical, and negotiating abilities.
• The capacity to cooperate with the operations, risk, and finance teams as well as work independently.
