Details of the Job/Internship
Mahindra Home Finance is hiring a Litigation Manager (SARFAESI) to handle legal proceedings related to recovery of secured assets under the SARFAESI Act, 2002, representing banks and NBFCs before courts and tribunals.
Role and Responsibilities
- Initiate and manage actions under Sections 13(2), 13(4), and 14 of the SARFAESI Act.
- Draft and issue demand notices, possession notices, and sale notices.
- Coordinate with District Magistrates or Chief Metropolitan Magistrates for possession orders.
- Appear before DRT, DRAT, Civil Courts, and High Court.
- Handle Securitisation Applications filed by borrowers.
- Draft counter affidavits, replies, rejoinders, and written submissions.
- Argue interim applications and recovery matters.
- Coordinate with advocates, recovery agents, and auctioneers.
- Oversee physical and symbolic possession of secured assets.
- Ensure compliance with RBI guidelines and bank policies.
- Vet loan documents, mortgage deeds, and guarantee agreements.
- Maintain litigation trackers and case status reports.
- Ensure timelines under the SARFAESI Act are strictly followed.
- Liaise with branch officials, valuers, and legal vendors.
- Prepare MIS reports for management.
- Advise bank/NBFC on legal risks and recovery strategy.
