American Express is hiring for the position of Manager & Counsel to join their office in Gurugram.
Role and Responsibilities
The Role:
This role is based in Gurgaon, India with an overview of other locations in India (primarily Bangalore and Mumbai) and possibly locations outside India in the future. This role is for an Associate Employment Counsel who as part of a team will be reporting into Employment Counsel for India, Aparna Shrian.
Purpose of the Role:
This role will require supporting and advising the Human Resources team for all business lines in American Express India, having an employee strength of approximately 20,000+. The Colleague and Labour Relations team, the Compensations and Benefits team and the Talent Acquisition team will be the main client focus of this role. The demands of the role require a considerable degree of flexibility, reflecting the matrix structure of the business. The candidate will need to establish themselves as a partner to the HR functions to advise on a day-to-day Employment law matters as well as on Diversity and Inclusion matters.
Responsibilities:
- Provide support to the Human Resources teams (especially the Colleague Relations team) in India by directly delivering employment law advice on a day-to-day basis.
- Working closely with Compensation and Benefits team and Colleague Relations to identify and correct gaps in complying with employment laws and regulations.
- Specifically keeping in mind, the latest amendments in Law.
- Advising in relation to disciplinary matters and process, including on Compliance requirements under various employment laws.
- Provide support on the implementation of legal developments and initiatives and review of related materials, drafting of policies and procedures.
- Manage litigation and working with outside counsel,
- Advising and providing support to various HR teams (including Business HR leaders) and Business Leaders on organizational changes and impact on employee related issues.
Eligibility
- India qualified lawyer specializing in employment law. In-house experience preferred.
- Must have prior experience of 7-10 year either in practice or in-house in providing advice on a wide range of employment issues including on disciplinary issues (with through knowledge of the Industrial Disputes Act), discrimination, grievance, redressal procedures, changes to terms and conditions of employment, severance, redundancy & reorganization issues including on various Shops and Establishment Acts across India(Specifically Karnataka, Maharashtra & Haryana) and Labour Compliances relating to the various States in India.
- Experience in drafting Employment Policies and Employment related documents.
- Experience in advising on issues of Provident Fund, Pensions and Statutory Benefits (Maternity, ESI, Gratuity and Bonus).
- Experience with employment laws related to a Bank a bonus.
