Details of the Job/Internship

D. M. Legal Associates (DML) is hiring for the position of Non Litigation - Real Estate to join their office in Mumbai.

Role and Responsibilities

1. Non-Litigation Management:

Oversee all aspects of non-litigation legal work, ensuring comprehensive management and resolution of non-litigious matters.
Collaborate with internal teams, law firms, advocates, and solicitors to streamline processes and align legal strategies with organizational goals.

2. Due Diligence & Land Acquisition:

Conduct thorough due diligence for land acquisitions, including legal verification of titles and compliance checks.
Assist in structuring acquisitions to minimize risks and ensure legal and financial compliance.
Assess land acquisition deals, focusing on zoning laws, regulatory compliance, and statutory obligations.

3. Legal Documentation & Vetting:

Draft, review, and vet a wide array of legal documents, including:
Agreements for Sale, Lease Agreements, Development Agreements, Tenancy Agreements, Deeds of Conveyance, Deeds of Gift, Powers of Attorney, Affidavits, and other property-related contracts.
Documents related to Mortgages, Hypothecation, Pledge, and other financial arrangements.
Ensure accuracy and legal soundness in all documentation to safeguard the firm’s interests.

4. Regulatory Compliance:

Ensure compliance with RERA, IBC, and other relevant legal frameworks, staying updated with regulatory changes.
Manage compliance requirements for real estate projects, including necessary filings and statutory obligations.
Handle annual disclosures and statutory registers in accordance with the Companies Act.

5. Dispute Resolution & Litigation Support:

Assist in resolving property-related disputes, including mediation and arbitration.
Draft legal arguments, motions, and other court documents related to real estate disputes.
Coordinate with litigation teams to provide strategic inputs and facilitate smooth case management.

6. Stakeholder Management:

Maintain effective communication with property developers, government authorities, regulatory bodies, and financial institutions.
Facilitate project approvals and ensure regulatory compliance through proactive stakeholder engagement.

Eligibility

1. Legal Expertise:

Minimum 3 years of practice in real estate law, with specialization in property laws, regulatory compliance, and contract management.
Strong experience in drafting, reviewing, and negotiating property-related documents, including sales contracts, leases, and financing agreements.

2. Commercial Drafting Skills:

Expertise in commercial drafting, with the ability to create precise and legally sound documents tailored to commercial real estate transactions.
Proficiency in preparing legal arguments and drafting for both project-related work and court proceedings.

3. Due Diligence & Risk Assessment:

Skilled in conducting due diligence for property transactions, including title verification, compliance checks, and risk assessment.
Knowledge of environmental assessments and legal risks associated with property acquisitions.

4. Negotiation & Communication:

Strong negotiation skills, with the ability to engage in settlement discussions and represent the firm effectively.
Excellent verbal and written communication skills, ensuring clarity in legal documentation and client interactions.
