Details of the Job/Internship

HDFC Bank is hiring for the position of Senior Legal Manager -Department for Special Operations with 10-15 years of experience to join their office in Mumbai Metropolitan Region.

Role and Responsibilities

Legal Vetting:

• Review and vet all legal notices issued under SARFAESI Act, RDDB Act, Companies Act, Negotiable Instruments Act, and matters related to derivative transactions.
• Ensure appropriate responses to all legal notices received by the bank.
• Vet cases filed by the bank for debt recovery, including applications under the Bankruptcy and Insolvency Act.
• Provide legal oversight for correspondence with defaulters.

2. Liaising with External Counsels and Law Firms:

• Identify and engage with law firms and senior counsels with banking and litigation expertise.
• Brief counsels on complex legal matters and provide strategic direction.
• Negotiate fee structures and manage budgets effectively.
• Monitor advocates to ensure proper representation of the bank’s interests in court and during legal documentation.
• Conduct periodic reviews with advocates to assess case progress.

3. Litigation Management:

• Directly handle high-value, complex cases in coordination with recovery managers.
• Attend court hearings and conferences to manage critical cases before DRT/DRAT/High Court.
• Provide legal support for asset recovery, including taking physical possession and conducting auctions.
• Defend the bank against borrower challenges and third-party interventions in SARFAESI actions.

4. Litigation Against the Bank:

• Oversee and manage suits and proceedings filed against the bank involving monetary claims.

5. Court Case Portal Management:

• Collaborate with recovery managers and the central legal team to manage and update the court case portal.
• Periodically review litigation matters against the bank and reconcile case reporting.

Eligibility

• LLB (Mandatory)
• LLM (Preferred)
• Minimum 10–15 years of experience in legal management, including 4–5 years in a banking environment.
• Proven experience in stress/restructuring and recovery-related legal matters.
• Demonstrated expertise in handling high-value, complex litigation in a banking context.
