Details of the Job/Internship
Central Bureau of Investigation (CBI) Anti-Corruption Branch in Patna, India. It invites applications for appointing/engaging Special Public Prosecutors (Retainer Counsels) to conduct legal proceedings in the Patna High Court on behalf of the CBI.
- For Courts in Delhi, Mumbai, Kolkata, and Chennai: Appearance Fee: ₹10,000 per case per day for effective hearings.
- Non-Effective Hearing Fee: 1/3rd of the effective hearing fee if the hearing doesn't proceed due to uncontrollable circumstances.
- Drafting Fee: ₹3,000 per pleading. Conference Charges: ₹1,000 per hour (up to 5 conferences per case/group of cases).
- Out-of-Pocket Expenses: ₹1,000 per case. Travel Allowance: As per Group-A Gazetted Officer rates.
- For Courts in Other Locations: Appearance Fee: ₹7,500 per case per day for effective hearings.
- Non-Effective Hearing Fee: 1/3rd of the effective hearing fee. Drafting Fee: ₹2,000 per pleading.
- Conference Charges: ₹600 per hour (up to 5 conferences per case/group of cases). Out-of-Pocket Expenses: ₹750 per case.
- Travel Allowance: As per Group-A Gazetted Officer rates.
- Additional Entitlements: Out-of-Headquarters Fee: ₹1,000 per day for days spent outside headquarters, including travel and holidays.
- Travel and Hotel Expenses: Reimbursement for travel (economy air/AC-II tier train) and reasonable hotel expenses (up to ₹2,250 per day).
- Clerkage: 10% of fees, capped at ₹1,800 per case or batch of cases.
- Miscellaneous Expenses: Advance for court fees and other minor expenses (up to ₹750).
Role and Responsibilities
- Conducting Prosecution, Appeals, Revisions, and other legal matters arising from cases investigated by the CBI in the Hon'ble Patna High Court.
- Representing the CBI in all stages of legal proceedings in the High Court.
- Preparing legal documents, drafting pleadings, and reviewing case files.
- Adhering to the general terms and conditions outlined and approved by the Government of India.
- Acting with the utmost integrity and maintaining confidentiality for all matters related to CBI cases.
- Delivering services for a tenure of three years, unless otherwise specified.
Eligibility
- A Bachelor of Laws (LL.B) degree.
- Must hold an Enrollment Certificate as an Advocate with the Bar Council.
- A minimum of 10 years' experience as an Advocate.
- Proven expertise in handling criminal cases in various courts, including High Courts.
- Must provide unconditional consent to work under the general terms and conditions approved by the Government of India.
Salary/Stipend
The remuneration for Special Public Prosecutors (Retainer Counsels) engaged by the CBI is governed by the terms outlined in the DoPT letter dated 8th April 2024.
