India currently requires 50,066 more Judges to clear the backlog of 3.7 crores cases that lie pending in India.
How did we arrive at this number?
The 120th Law Commission report stated that India needs 50 judges per 1 million population to adequately meet the litigation demands of this country.
Since India’s population is roughly 1.3 billion we require 69000 Judges to meet the requirement.
According to the Supreme Court’s latest news, we currently have 18934 Judges and 5589 seats lie vacant in line with ‘sanctioned strength’ of the Judges in High Courts and lower courts.

Every year, the Supreme Court increases the ‘sanctioned strength’ keeping the target of 50 judges per million.
In the last ten years, the sanctioned strength has increased by 39% adding a whopping 6885 seats to be filled by the eligible candidates.
Despite that 22% of the seats lie vacant today.
When we calculated the year by year data it was concluded that if the sanctioned strength of the courts are increased at the same rate as they have for the last ten years then, India will need to have a sanctioned strength of 28814 by 2023.
Currently we have 18,934 Judges in the country and therefore we will need 9880 additional judges by 2023 to meet the sanctioned strength of the future.
24 states in India regularly conduct lower judiciary exams to admit judges at the lowest cadre.
States have been gravely criticized about what judges get paid. Why will good lawyers who can earn a lot in practice be willing to become a judge unless judges are paid really well!
The government is relentlessly introducing attractive pay packages and lucrative perks to attract more candidates to appear for the judiciary examination. For instance, the Second National Judicial Pay Commission has increased the salary of the judges by three times along with several attractive perks.
So basically, more judges are being hired, with a massive unprecedented increase of vacancies on the cards. Government is actively working on making this profession attractive. Was there a better time ever to prepare for the judiciary exam?
Yet, the governments are struggling to fill up the vacancies they have already announced.
Hundreds of coaching centres train tens of thousands of law students for these judiciary exams and yet state judiciaries cannot find a few hundred judicial officers to fill all their vacancies.
For instance in 2019, Punjab and Haryana was able to fill only 30% of the seats advertised although the number of the students who appeared were 100 times more than the vacant seats.
In 2019, for the Delhi Judiciary exam, 66% seats could not be filled although more than 12 thousand students appeared for the examination as people did not score the cut off marks.
What is going wrong here?
